These Terms of Use ("Terms") govern your access to and use of the websites, mobile applications, online dating services, and community features (collectively, the "Services") provided by FINDING LLC, doing business as Finding Adam Finding Eve ("FAFE," "we," "us," or "our"), including the FINDING Dating Service available through findingadamfindingeve.com. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please do not use our Services.
1. Eligibility
You must be at least 21 years of age to use our Services, including the FINDING Dating Service. By using the Services, you represent and warrant that you meet this age requirement, have the legal capacity to enter into these Terms, and are seeking to use the FINDING Dating Service for personal, non-commercial purposes to connect with others for potential relationships. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Your Account
To access certain features of the Services, including the FINDING Dating Service, you must create an account. You agree to provide accurate, current, and complete information during registration, including information relevant to your dating profile (e.g., personal details, preferences, and photos), and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, including interactions through the FINDING Dating Service. Notify us immediately at support@findingadamfindingeve.com if you suspect any unauthorized use of your account or experience any harassment or misconduct through the Services.
3. Acceptable Use
You agree to use the Services, including the FINDING Dating Service, only for lawful purposes and in accordance with these Terms. You may not:
- Post, upload, or share content, including dating profile information or messages, that is unlawful, harmful, defamatory, obscene, discriminatory, or otherwise objectionable;
- Engage in any activity that interferes with or disrupts the Services, including introducing viruses, malicious code, or engaging in spamming or phishing attempts;
- Attempt to gain unauthorized access to any part of the Services, including other users’ accounts or private messages;
- Use the Services, including the FINDING Dating Service, to harass, abuse, stalk, or harm others, or to solicit or promote commercial activities unrelated to the Services;
- Impersonate any person or entity, misrepresent your identity, or provide false information in your dating profile or communications.
We reserve the right to remove any content, including dating profiles or messages, or suspend/terminate your access to the Services, including the FINDING Dating Service, for violations of these Terms or for any reported harassment or misconduct, at our sole discretion.
4. FINDING Dating Service Rules and Guidelines
The FINDING Dating Service is designed to facilitate meaningful connections between users. To ensure a safe and respectful community, you agree to the following additional rules and guidelines when using the FINDING Dating Service:
- No Liability for Member Actions: We are not responsible for malicious actions by members of our community. You acknowledge that interactions with other users, whether online or offline, are at your own risk.
- No Vetting or Endorsement of Members: We do not require or vouch for any member of the community, including with respect to their legal or criminal past. While we do our best to vet FINDING Dating Service participants, we strongly recommend that you conduct your own research, meet in safe public places, and practice safe dating practices. - Reporting Harassment or Misconduct: If you experience any forms of harassment or misconduct through the FINDING Dating Service, please notify us immediately at support@findingadamfindingeve.com. We will investigate and take appropriate action, which may include suspending or terminating the offending user’s access.
- Cancellation of Participation: If you would like to cancel your participation in the FINDING Dating Service at any time, please contact your matchmaker (if applicable) or email support@findingadamfindingeve.com. Upon cancellation, your dating profile and related features will be deactivated, though certain provisions of these Terms will survive as noted in Section 9.
5. User Content
The Services, including the FINDING Dating Service, allow you to submit, post, or upload content, such as text, images, profile details, or messages ("User Content"). You retain ownership of your User Content, but by submitting it, you grant FAFE a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, modify, and display your User Content in connection with operating, improving, and promoting the Services, including featuring dating profiles or community content. You represent that you have the necessary rights to grant this license and that your User Content does not violate any third-party rights, applicable laws, or community standards of respect and authenticity.
6. Intellectual Property
All content, trademarks, logos, and materials available through the Services (excluding User Content), including the design and functionality of the FINDING Dating Service and findingadamfindingeve.com, are the property of FINDING LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent, except as permitted under these Terms.
7. SMS Messaging
By providing your mobile phone number and opting in to receive SMS messages from FAFE, you consent to receive text messages related to the Services, including promotional messages, account updates, service notifications, and alerts related to the FINDING Dating Service (e.g., match notifications or message alerts). These messages may be sent using automated technology.
- Opt-In: You may opt in to SMS messaging during account registration, through your dating profile settings, or via other designated methods provided in the Services. Opting in is not a condition of using the Services or the FINDING Dating Service.
- Message Frequency and Costs: Message frequency may vary based on your activity within the FINDING Dating Service. Standard message and data rates may apply, as determined by your mobile carrier. Check with your carrier for details.
- Opt-Out: You may opt out of SMS messaging at any time by replying "STOP" to any message you receive or by contacting us at support@findingadamfindingeve.com. After opting out, you may still receive non-promotional messages, such as those related to account security or transactional updates, if permitted by law.
- Support: For help with SMS messaging, reply "HELP" to any message or email support@findingadamfindingeve.com.
Your personal information, including your phone number, will be handled in accordance with our Privacy Policy. You represent that you are the account holder or have authorization to use the phone number provided for SMS messaging.
8. Privacy
Your use of the Services, including the FINDING Dating Service and SMS messaging, is governed by our Privacy Policy, available at [Privacy]. Please review it to understand how we collect, use, and protect your personal information, including data related to your dating profile and interactions.
9. Third-Party Links and Services
The Services, including the FINDING Dating Service, may contain links to third-party websites or services (e.g., payment processors or background check services) that are not owned or controlled by FAFE. We are not responsible for the content, policies, or practices of these third parties, including any third-party SMS messaging services we may use. Your interactions with them, including any background checks you choose to conduct, are at your own risk.
10. Termination
We may suspend or terminate your access to the Services, including the FINDING Dating Service and SMS messaging, at any time, with or without notice, for any reason, including if we believe you have violated these Terms, engaged in inappropriate conduct within the dating community, or based on reports of harassment or misconduct. You may discontinue using the Services, including canceling your participation in the FINDING Dating Service, by contacting your matchmaker or support@findingadamfindingeve.com. Upon termination, your rights to use the Services, including your dating profile and related features, will cease, though provisions such as Intellectual Property, Limitation of Liability, and Governing Law will survive.
11. Disclaimer of Warranties
The Services, including the FINDING Dating Service and SMS messaging, are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. FAFE does not guarantee that the Services, including the FINDING Dating Service, will be uninterrupted, error-free, secure, or that any matches or interactions will meet your expectations. 12. Limitation of Liability
To the fullest extent permitted by law, FINDING LLC, its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, including the FINDING Dating Service or SMS messaging, or from the actions of other users, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Services will not exceed $100.
13. Indemnification
You agree to indemnify and hold harmless FINDING LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Services, including the FINDING Dating Service, your User Content, your interactions with other users, or your violation of these Terms or any applicable law.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Services, including the FINDING Dating Service. We will notify you of material changes by posting the updated Terms on our website or through the Services, with the "Last Updated" date revised accordingly. Your continued use of the Services, including the FINDING Dating Service and SMS messaging, after such changes constitutes your acceptance of the updated Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law principles. Any disputes arising from these Terms or the Services, including the FINDING Dating Service or SMS messaging, will be resolved through binding arbitration in Kansas City, Missouri, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
